Terms and Conditions (T&Cs)
for the Booking and Participation in Workshops

1. Scope of Application
These Terms and Conditions apply to the booking of and participation in workshops and courses on miniature, scale model, and figure painting offered and conducted by

hereinafter referred to as the “Organizer.”
The workshops are intended for both beginners and advanced participants. The information published on the website for the respective workshop, including its content, duration, location, date, price, and included services, shall be decisive.
2. Booking and Conclusion of Contract
The presentation of workshops on the website does not constitute a binding offer to enter into a contract.
By submitting a booking, the customer makes a binding offer to enter into a contract for participation in the selected workshop.
The contract is concluded once the Organizer confirms the booking by email or otherwise expressly accepts the booking.
The number of available participant places is limited. A claim to a specific place only arises after the contract has been successfully concluded.
3. Workshop Services
The scope of the services owed is determined by the workshop description published on the website.
A one-day workshop generally consists of approximately 6 hours of instruction.
A two-day workshop generally consists of 2 workshop days, each lasting approximately 6–8 hours.
Where stated in the respective workshop description, the workshop may include, in particular:
- personal instruction and supervision,
- practical demonstrations,
- use of paints and tools,
- provision of miniatures or other materials,
- workshop notes or other learning materials.
The materials and services included in the price are specified in the respective workshop description.
The Organizer reserves the right to make minor adjustments to individual contents or the schedule for organizational or educational reasons, provided that the overall character and learning objectives of the workshop are not substantially altered.
4. Prices and Payment
The prices stated on the website at the time of booking are final prices.
The Organizer applies the small business exemption pursuant to Section 19 of the German Value Added Tax Act (UStG). Therefore, VAT is not separately stated on invoices.
Information regarding payment will be provided to the participant together with the booking confirmation by email.
5. Cancellation by the Participant
The participant may cancel the booking free of charge up to 14 days before the start of the workshop.
If the booking is cancelled within 14 days before the workshop begins, there is generally no entitlement to a full refund of the participation fee.
However, the participant may designate a substitute participant at any time. The substitute participant must meet the participation requirements applicable to the respective workshop. The Organizer must be informed of the substitute participant in good time before the workshop begins.
If the participant can demonstrate that the Organizer suffered no loss, or substantially less loss, as a result of the late cancellation, only the actual loss or expenses actually incurred shall be reimbursed.
Cancellations or the designation of a substitute participant should be made in text form, in particular by email.
6. Illness of the Participant
If a participant is unable to attend the booked workshop due to illness, they should inform the Organizer as early as possible.
Where possible, the Organizer may offer the participant the opportunity to attend another workshop. There is no entitlement to a particular replacement date, and this is subject to a suitable place being available.
Alternatively, a substitute participant may attend by prior agreement.
The participant’s statutory rights remain unaffected.
7. Non-Attendance and Late Arrival
If a participant fails to attend without prior cancellation, there is generally no entitlement to a refund of the participation fee.
Late arrival generally does not entitle the participant to an extension of the workshop or to a partial refund of the participation fee.
For two-day workshops, failure to attend one of the workshop days generally does not entitle the participant to a partial refund if the non-attendance is attributable to the participant.
8. Right of Withdrawal
The workshops offered are events booked for a specific date or period.
Where the statutory requirements of Section 312g(2)(9) of the German Civil Code (BGB) are met, there is therefore no statutory right of withdrawal for the booking.
The participant will be informed of this before submitting the booking.
The possibility of cancelling free of charge up to 14 days before the workshop begins, as provided for in these Terms and Conditions, remains unaffected.
9. Cancellation or Rescheduling by the Organizer
The Organizer is entitled to cancel a workshop or reschedule it to another date for good cause.
Good cause may include, in particular:
- illness of the Organizer or workshop instructor,
- force majeure,
- the unavailability of the workshop venue,
- technical or organizational circumstances that make the workshop impossible or unreasonable to conduct,
- an insufficient number of participants, provided that a minimum number of participants has been specified in the respective workshop description.
If the Organizer cancels the workshop, the participation fee already paid will be refunded in full.
If the workshop is rescheduled to an alternative date, the participant may choose either to attend the replacement date or to receive a full refund of the participation fee already paid.
Any further statutory claims remain unaffected.
10. Venue and House Rules
The workshops take place at the venue specified in the respective workshop description.
Participants must comply with the venue’s house rules and with the instructions of the Organizer and the responsible staff at the venue.
The Organizer is entitled to exclude participants from the workshop in cases of significant disruptive behavior or where other persons are endangered.
If exclusion is necessary due to conduct for which the participant is responsible, there is generally no entitlement to a refund of the participation fee.
11. Use of Paints, Tools, and Materials
The paints, tools, and other materials used during the workshop must be handled carefully and used only for their intended purpose.
Participants are required to follow the Organizer’s instructions regarding the safe use of tools, paints, and other materials.
In the event of intentional or grossly negligent damage to items provided, the Organizer may claim compensation for the resulting damage.
12. Participants’ Own Miniatures and Materials
Participants may bring their own miniatures or materials where this is compatible with the respective workshop description.
Participants bring and use their own items at their own risk.
The Organizer is not liable for the loss of or damage to items brought by participants unless such loss or damage results from an intentional or grossly negligent breach of duty by the Organizer.
13. Photography and Video Recording
The Organizer may take photographs and video recordings during workshops for documentation and content creation purposes.
The taking of photographs or videos during the workshop does not constitute consent to their publication.
Photographs or videos in which participants are identifiable will be published only with the prior consent of the respective person.
Consent to publication is voluntary and is not a condition of participation in the workshop.
Any consent given may be withdrawn at any time with effect for the future.
Photographs or videos showing only miniatures and work created by the Organizer or participants may be published independently of the above, provided that no persons are identifiable and no third-party rights prevent publication.
14. Workshop Materials and Intellectual Property
Workshop materials, instructions, texts, images, presentations, and other materials provided by the Organizer are protected by copyright.
Participants may use these materials for private purposes.
Reproduction, publication, distribution, commercial use, or any other exploitation of the materials provided is not permitted without the prior consent of the Organizer.
Miniatures and models created by participants themselves during the workshop may, of course, be used for private purposes as well as for the participant’s own presentation and publication.
15. Liability
The Organizer shall be fully liable for damages resulting from an intentional or grossly negligent breach of duty by the Organizer, its legal representatives, or its agents.
For damages caused by ordinary negligence, the Organizer shall only be liable in the event of a breach of essential contractual obligations. In such cases, liability is limited to the foreseeable damage typical for this type of contract.
The above limitations of liability do not apply to damages resulting from injury to life, body, or health, or in cases of mandatory statutory liability.
16. Data Protection
Personal data is processed in accordance with the applicable data protection laws.
Further information on the processing of personal data, including the purpose, scope, and duration of processing, can be found in the Organizer’s Privacy Policy.
17. Consumer Dispute Resolution
The Organizer is neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board.
If, due to the specific circumstances of the business, there is a statutory obligation to participate in consumer dispute resolution proceedings, the applicable legal provisions shall apply.
18. Final Provisions
The law of the Federal Republic of Germany shall apply.
For consumers, the statutory rules governing jurisdiction shall apply.
Should any individual provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
